1. Overview

This website is operated by JB’s Coastal Creations. Throughout the site, the terms “we”, “us” and “our” refer to JB’s Coastal Creations. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

These Terms of Service apply to all users of the site, including browsers, vendors, customers, merchants, and/or contributors of content.

2. Custom & Personalized Orders (Important)

Because our products are handmade and permanently personalized, specific terms apply to these orders:

• Customer Accuracy: You are responsible for ensuring all text, dates, names, and personalization details are correct at the time of purchase. We engrave/create exactly what you type. We are not responsible for spelling errors, incorrect dates, or typos submitted by you.
• To Secure Your Order: A 50% non-refundable deposit is necessary to reserve your order in our schedule. This payment must be made in advance, before any work, products, or services begin.
• No Cancellations on Custom Work: Once an order is placed and production has begun, it cannot be cancelled or refunded.
• Image Quality: If you upload an image for laser engraving, you are responsible for providing a high-quality, high-contrast image. We reserve the right to request a better image if the one provided will not produce a quality result. If you cannot provide a suitable image, we reserve the right to cancel the order.
• Right to Refuse: We reserve the right to refuse to engrave or create content that is offensive, hate speech, or explicit in nature.

3. The Nature of Handmade Goods (Epoxy & Wood)

Our products are handcrafted, not mass-produced in a factory. By purchasing, you acknowledge and accept the following:

• Epoxy Resin: Resin is a fluid medium. Small imperfections, such as micro-bubbles, slight waves, or variations in color mixing, are normal and are part of the handmade process. These are not considered defects.
• Wood Grain: Wood is a natural material. The grain pattern, color, and texture of the wood may vary from the photos on our website. Laser engraving may appear lighter or darker depending on the density of the wood grain.
• Uniqueness: No two items will be exactly alike.

4. Payment Terms

• Prices for our products are subject to change without notice.
• Payment Processing: We use Authorize.net to securely process payments. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
• Currency: All prices are listed in Bermuda Dollars (BMD) (or USD, as they are pegged 1:1) unless otherwise stated.

5. Shipping, Delivery & Pickup

• Local Collection: If you advise local collection with your order, we will notify you when your order is ready. Orders must be collected within 7 days of notification unless otherwise communicated.
• Shipping: We are not responsible for delays caused by the carrier (e.g., Bermuda Post Office, courier services) once the package has left our facility.
• Customs/Duties (International): If we ship internationally, you are responsible for any customs duties or taxes applied by your country.

6. Returns & Refunds

Standard Products: For non-customized items, you may request a return within 5 days of receipt if the item is unused and in original packaging.

Custom Products: All sales are final for personalized or custom-made items. We only offer replacements or refunds on custom items if:

1. The item arrived broken/damaged.
2. We made an error (e.g., we engraved a name differently than what you typed on the order form).

In these cases, you must contact us within 48 hours of receiving the item with photos of the damage/error.

7. Intellectual Property & User Content

• Your Content: By submitting a photo or design for us to use, you warrant that you own the rights to that image or have permission to use it. You agree to indemnify JB’s Coastal Creations against any legal claims regarding copyright infringement arising from images you provide.
• Our Designs: All designs, photos, and content on this website created by JB’s Coastal Creations are our intellectual property and may not be used without permission.

8. Limitation of Liability

To the fullest extent permitted by Bermuda law, JB’s Coastal Creations shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind arising from your use of any of our products.

9. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Bermuda. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bermuda.
